Terms & Conditions

Please read these terms carefully before booking your tour

1. Introduction

Welcome to Berkat Tours. These Terms and Conditions govern your use of our services and booking of tours. By making a booking with Berkat Tours, you acknowledge that you have read, understood, and agree to be bound by these terms.

Berkat Tours ("we," "us," "our") is a Malaysian-based travel agency specializing in Muslim-friendly tours to New Zealand. Our company registration details are available upon request.

2. Booking and Payment

2.1 Reservation Process

To book a tour with Berkat Tours:

  • Complete our online booking form or contact us directly via phone/email
  • Receive booking confirmation with invoice
  • Pay the required deposit within 48 hours to secure your reservation
  • Provide all required documentation (passport copies, visa information, etc.)

2.2 Payment Schedule

Payment terms are as follows:

  • Deposit: 30% of total tour cost due upon booking confirmation
  • Final Payment: Remaining 70% due 60 days before departure date
  • Late Bookings: Bookings made within 60 days of departure require full payment immediately

2.3 Accepted Payment Methods

  • Bank transfer (preferred method)
  • Credit/debit cards (Visa, Mastercard) - processing fees may apply
  • Online payment platforms (as specified)

3. Cancellation Policy

Cancellations must be submitted in writing via email to info[at]berkattours.co.nz

3.1 Cancellation by the Traveler

Cancellation fees reflect the actual costs Berkat Tours incurs with suppliers and service providers at the time of cancellation:

  • 90+ days before departure: Deposit forfeited (covers administrative and confirmed booking costs). Remainder refunded within 14 working days.
  • 60-89 days before departure: 50% of total tour cost forfeited (reflects confirmed supplier commitments).
  • 30-59 days before departure: 75% of total tour cost forfeited (reflects non-recoverable supplier payments).
  • Less than 30 days before departure: 1Up to 90% of total tour cost forfeited (reflects fully committed supplier costs). Any amounts recoverable from our suppliers will be refunded to you, less a reasonable administration fee.

If Berkat Tours is able to resell your tour place, we will refund the difference between the cancellation fee and the resale amount, less a reasonable administration fee.

All refunds will be processed within 14 working days to the original payment method.

3.2 Cancellation by Berkat Tours

If Berkat Tours cancels a tour for reasons within our control (e.g., insufficient bookings, operational decisions), you will receive a full refund of all payments made, processed within 14 working days.

If Berkat Tours needs to cancel due to circumstances beyond our control, Section 3.4 (Force Majeure) applies.

3.3 No-Show Policy

Failure to show up for departure without prior notice will result in forfeiture of up to 90% of total payments. Any amounts recoverable from suppliers will be refunded, less a reasonable administration fee. We encourage travelers to contact us as early as possible if they are unable to travel.

3.4 Force Majeure (Circumstances Beyond Control)

In the event that a tour cannot proceed due to circumstances beyond either party's reasonable control — including but not limited to natural disasters, pandemics, government travel restrictions, severe weather events, or political unrest — cancellation and refunds will be handled in accordance with the Contract and Commercial Law Act 2017 (Subpart 4 — Frustrated Contracts).

Under these circumstances:

  • Berkat Tours will refund all payments made, less any actual, reasonable costs already incurred with third-party suppliers that cannot be recovered.
  • Berkat Tours will provide an itemised breakdown of any costs retained upon request.
  • Where possible, we will offer the option to reschedule your tour to an alternative date at no additional cost, subject to availability.

4. Travel Insurance

We strongly recommend purchasing comprehensive travel insurance covering:

  • Trip cancellation/interruption
  • Medical emergencies and evacuation
  • Lost or delayed baggage
  • Flight delays or cancellations
  • Personal liability

Important: Berkat Tours is not liable for any costs arising from circumstances that would have been covered by adequate travel insurance.

5. Travel Documentation

All travelers are responsible for obtaining and maintaining valid travel documents:

  • Valid passport (minimum 6 months validity from return date)
  • NZeTA (New Zealand Electronic Travel Authority) for Malaysian passport holders
  • Any required visas for transit countries
  • Vaccination certificates if required

We provide guidance and assistance with NZeTA applications but are not responsible for any delays, rejections, or issues arising from documentation problems.

6. Halal Commitments

We make every effort to provide 100% halal dining experiences through:

  • FIANZ (Federation of Islamic Associations of New Zealand) certified restaurants
  • Verified halal suppliers and caterers
  • Vegetarian and seafood options when halal certification is unavailable

Disclaimer: While we strive for complete halal compliance, we cannot guarantee 100% halal status in all situations. We recommend travelers exercise personal judgment and verify with restaurant staff when needed.

7. Accommodation and Services

All accommodations and services are subject to availability. If a confirmed accommodation becomes unavailable, Berkat Tours will provide an alternative of equivalent or higher standard at no additional cost.

If the alternative accommodation is of a materially lower standard, or is not acceptable to the traveler, the traveler may:

  • Accept the alternative with an appropriate price adjustment; or
  • Cancel the affected portion of the tour and receive a refund for that portion.

Accommodation arrangements may include:

  • Service apartments
  • Holiday homes
  • Motels
  • HFamily apartments

8. Conduct and Behavior

All travelers are expected to:

  • Respect local laws, customs, and Islamic values
  • Follow tour guide instructions for safety and schedule adherence
  • Treat fellow travelers, guides, and local communities with respect
  • Be punctual for scheduled activities and departures

We reserve the right to remove any traveler from a tour if their behavior is deemed disruptive, dangerous, or inappropriate. In such cases, the traveler will receive a refund for any unused tour portions, less actual costs incurred by Berkat Tours. No refund will be provided for tour portions already completed.

9. Liability and Disclaimer

Berkat Tours acts as an agent for various service providers (airlines, hotels, transport companies, etc.). We are not liable for:

  • Acts, omissions, or defaults of third-party service providers
  • Personal injury, illness, or death during the tour
  • Loss or damage to personal property
  • Delays, cancellations, or changes to flights or other services
  • Force majeure events (natural disasters, pandemics, political unrest, etc.)

Nothing in these terms excludes or limits your rights under the New Zealand Consumer Guarantees Act 1993. Under the Consumer Guarantees Act, services must be carried out with reasonable care and skill and be fit for purpose. Where Berkat Tours fails to meet these guarantees, you may be entitled to a remedy including compensation, a refund, or having the issue remedied, in accordance with the Act.

10. Privacy and Data Protection

We collect and process personal information in accordance with our Privacy Policy. By booking with us, you consent to the collection and use of your data for:

  • Tour booking and administration
  • Communication regarding your tour
  • Legal and regulatory compliance
  • Marketing communications (with your consent)

11. Changes to Itinerary

While we make every effort to operate tours as advertised, we reserve the right to make changes to:

  • Itinerary order or activities due to weather, safety, or operational reasons
  • Accommodation or transport of similar or higher standard

We will notify you of any changes as soon as possible.

Price Changes: Tour prices are confirmed at the time of booking. In the rare event that significant cost increases (exceeding 5% of the total tour cost) arise due to currency fluctuations, fuel costs, or government taxes, we will notify you as soon as possible. In such cases, you may:

  • Accept the revised price; or
  • Cancel the booking and receive a full refund of all payments made.

Price adjustments of 5% or less may be applied and will be communicated to you before final payment is due.

12. Photography and Marketing

By participating in our tours, you grant Berkat Tours permission to use photographs or videos taken during the tour for marketing purposes. You may opt out at any time by informing your tour guide verbally or by notifying us in writing at info@berkattours.co.nz. We will make reasonable efforts to exclude you from future marketing materials upon request.

13. Complaints and Disputes

If you have any complaints during your tour, please inform your tour guide immediately so we can attempt to resolve the issue.

14. Governing Law

These Terms and Conditions are governed by the laws of Malaysia. However, nothing in these terms excludes, restricts, or modifies your rights under New Zealand consumer protection laws, including the Consumer Guarantees Act 1993, the Fair Trading Act 1986, and the Contract and Commercial Law Act 2017, where applicable. For disputes arising in relation to services provided in New Zealand, you may also seek resolution through the New Zealand Disputes Tribunal or District Court.
